These Terms of Service (“Terms”) govern your use of the website at fetewell.com (the “Site”), which is operated by Dear Properties LLC, doing business as Fêtewell (“Fêtewell,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

About Fêtewell venues: The Fêtewell brand includes both venues operated by Dear Properties LLC or its affiliates and venues operated by independent franchisees licensed to use the Fêtewell brand. Each franchisee-operated venue is a separate legal entity, responsible for its own bookings, operations, contracts, and conduct. References to “Fêtewell” on the Site refer to the brand as a whole; legal responsibility for any specific venue lies with the entity that operates that venue.

Important: These Terms apply only to your use of the Site. They do not replace, modify, or override any signed venue rental agreement, contract, or other written agreement between you and any Fêtewell venue. The terms of your venue rental are governed exclusively by your signed rental contract with the entity that operates that venue.

1. Use of the Site

You may use the Site for personal, non-commercial purposes related to learning about our venues, requesting information, and booking tours. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Copy, scrape, harvest, or republish content from the Site without our written permission
  • Use automated tools (bots, crawlers, scrapers) to access the Site, except for standard search engine indexing
  • Interfere with or disrupt the Site or its servers
  • Attempt to gain unauthorized access to any part of the Site
  • Submit false, misleading, or fraudulent information through any form on the Site
  • Use the Site in any way that could harm Fêtewell, our clients, or other visitors

2. Tour Requests and Inquiries

The Site allows you to request information, book tours, and submit inquiries about our venues. Please note:

  • A tour request or inquiry is not a contract. It does not reserve a date, hold a venue, or guarantee availability.
  • Tours are subject to scheduling availability and confirmation by our team.
  • Pricing, availability, and venue details shown on the Site are subject to change without notice.
  • Any booking of a Fêtewell venue requires a separate signed rental agreement.

3. Intellectual Property

All content on the Site, including text, photography, graphics, logos, videos, design, and branding, is owned by or licensed to Dear Properties LLC and is protected by copyright, trademark, and other intellectual property laws.

The names “Fêtewell,” “Continental Square Ballroom,” “Main Street Ballroom,” “Citizens Ballroom,” “Provisions House,” “Savannah Bottle Works,” and associated logos are trademarks of Dear Properties LLC. You may not use these marks without our prior written consent.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written permission, except that you may share links to publicly accessible pages on social media in their original, unmodified form.

4. User Submissions

If you submit information through a form on the Site (including your name, email, phone, event details, or other information), you represent that the information is accurate and that you have the right to provide it. You grant Fêtewell a non-exclusive, worldwide, royalty-free license to use that information for the purposes described in our Privacy Policy, including responding to your inquiry, scheduling tours, and providing services.

If you submit testimonials, photos, reviews, or other content to Fêtewell (whether through the Site, social media, email, or otherwise), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute that content for marketing and promotional purposes, with attribution where reasonable.

5. Photography and Marketing

Fêtewell venues frequently host events that are photographed or filmed by professional photographers, videographers, our team, and clients. If you attend an event at one of our venues, you may be captured in photos or video that we or our clients may use for marketing. If you have specific concerns about your image being used, please contact us in writing at [email protected] before your event.

If you are a client booking a Fêtewell venue, any specific terms regarding photography and marketing use of your event will be addressed in your signed rental contract.

The Site may link to third-party websites, including social media platforms, vendor websites, scheduling tools (such as Calendly), and other resources. We do not control these third parties and are not responsible for their content, privacy practices, or terms. Your use of any third-party website or service is at your own risk and subject to that third party’s terms.

7. Disclaimers

The Site and all content on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Fêtewell disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

While we work to keep information on the Site accurate, we do not guarantee that all content is current, complete, or free of errors. Pricing, availability, and venue details may change without notice. Photographs of venues are representative and actual conditions may vary, particularly during renovation periods.

8. Limitation of Liability

To the fullest extent permitted by law, Fêtewell, Dear Properties LLC, our parent and affiliated entities (including each LLC that operates a Fêtewell venue), and our and their respective owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site, including loss of profits, data, goodwill, or business opportunity, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or related to your use of the Site is limited to one hundred U.S. dollars ($100) or the amount you have paid us in the twelve (12) months prior to the claim, whichever is greater.

Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any other liability that cannot be excluded under applicable law.

This Section 8 governs use of the Site only. It does not limit any liability or rights arising under a signed venue rental agreement, which is governed by its own terms.

9. Indemnification

You agree to indemnify, defend, and hold harmless Fêtewell, Dear Properties LLC, our parent and affiliated entities (including each LLC that operates a Fêtewell venue), and our and their respective owners, officers, employees, contractors, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, your violation of any law, or your infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Frederick County, Maryland, and you consent to the personal jurisdiction of those courts.

If you are a resident of a state with consumer protection laws that grant you additional rights, nothing in this section is intended to waive those rights.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top. Your continued use of the Site after changes take effect means you accept the updated Terms. We encourage you to review these Terms periodically.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fêtewell regarding your use of the Site. They do not, however, replace or modify any signed venue rental contract.
